Landlord Liabilities: What Constitutes Negligence?

As a landlord, you have certain responsibilities when it comes to protecting your tenants and property.

Environmental Hazards

If you have any environmental hazards in your property and you do not take the necessary steps to remove them, this could be considered negligence. For example, if you have lead paint, asbestos, mold, or something similar in your property, you are going to need to remove this before putting tenants in the property.

Structural Issues

You should also make sure that the building does not have any significant structural issues. You need to make sure that the building meets all current building codes before renting it out. You also want to make sure that there are no leaks in the floor or in the wall.

Common Areas

As a landlord, you are also in charge of maintaining the common areas in a rental property. If these common areas are not maintained properly, you could be considered negligent. For example, if you do not keep a hallway lit and clean, someone could fall on something in the hallway and seriously injure themselves. In that case, you could be responsible for the accident.
